  • Rantz challenged claims that sitting members of Congress should receive special protection from criminal investigations.

A CNN panel erupted Tuesday after conservative radio host Jason Rantz presented facts about the federal investigation into Rep. Ilhan Omar of Minnesota. The discussion on NewsNight quickly exposed how little patience the liberal panelists had for details that complicated their preferred political narrative.

Omar is under investigation for immigration fraud. Federal agents executed a search warrant last week at her Washington, D.C., residence, where they seized her passport, computer, and phone.

The warrant was approved by a federal judge who is a Democrat, and the investigation traces back to the Biden administration. Those facts clash with Democratic efforts to portray the matter as President Donald Trump using the government against a political opponent.

Investigators are reportedly examining whether Omar misrepresented her age on immigration paperwork. They are also reportedly looking into the long-running claim that she married her brother, with DNA evidence reportedly playing a role in the case.

Omar denies wrongdoing and has characterized the investigation as political. She is also attempting to raise money from the controversy surrounding the search and federal investigation.

Liberal podcaster Leigh McGowan treated the search as evidence of tyranny and accused Trump of fascist conduct. “He is acting kind of textbook fascist behavior-like, when you start going after your political enemies like this,” McGowan said.

McGowan then declared, “It's not an investigation looking for the truth. It's a conclusion looking for a case, right?” Her framing dismissed the judge’s probable cause determination and the fact that the investigation began during the Biden administration.

McGowan also turned the conversation toward her own status as a naturalized citizen who criticizes the president. CNN’s Ana Navarro joined in, saying, “As a second naturalized citizen at the table, please don't give him any ideas.”

Rantz responded by returning the panel to the actual legal process behind the warrant. “It didn't alarm the judge that looked at the documents as part of an investigation that started under the Biden administration, and the judge looked at this and said, there's probable cause to move forward,” he said.

McGowan then argued that the standard for investigating a sitting member of Congress should be “very high.” Rantz challenged that position by asking whether George Santos should also have been protected from investigation because he served in Congress.

McGowan refused to engage with the comparison. “Don't do it this or that,” she said. “We're talking about Ilhan Omar .”

Rantz continued by highlighting the contradiction in the Democratic position. “The Democratic Party has said for years that they want to throw Donald Trump in jail,” he said.

“They say he's a criminal. They say that he's violated all sorts of laws, and it's coming from the very side that now is saying, well, actually, some people are above the law,” Rantz added.

McGowan responded by insisting that the Supreme Court had declared Trump above the law, an assertion Rantz corrected. He then pressed the central question raised by her argument, which was whether having a D next to a person’s name should provide protection from investigation.

“She hasn't committed a crime,” McGowan said. Yet the investigation exists to determine whether a crime occurred, and the judge concluded that the evidence presented established probable cause to proceed with the search.

Rantz also noted that members of Congress have faced investigations before. When the discussion turned to Senator Menendez, Rantz said, “They should have targeted Senator Menendez,” before adding, “They should target criminals, period.”

The exchange exposed a glaring political double standard. Democrats previously welcomed indictments, subpoenas, and raids aimed at Trump and his allies, while treating the FBI search of Mar-a-Lago as evidence of guilt.

Now that a judge who is a Democrat approved a warrant involving Omar, liberals on the panel suddenly treated the same legal machinery as fascism. The familiar claim that no one is above the law apparently became much less convenient when one of their own faced federal scrutiny.
