The Department of Education announced Monday that it will formally remove the Biden administration’s Title IX regulations, clearing the federal rulebook of provisions that expanded protections based on sexual orientation and gender identity.

The department will instead restore regulations issued during President Donald Trump’s first term. The change takes effect Tuesday under the final rule issued Monday.

Under the restored policy, the Education Department will recognize sex as male or female at birth when enforcing Title IX. That biological definition replaces the broader approach adopted by the Biden administration.

The Biden administration regulations had extended protections based on gender identity and sexual orientation to students and employees at federally funded schools. Monday’s action formally removes those provisions from the published regulations.

The 2024 rules also required schools to use transgender students’ pronouns. They additionally changed the process schools use to handle harassment complaints.

A federal court struck down the Biden administration rules in January 2025. The Education Department subsequently informed schools that it would enforce the 2020 rules issued during Trump’s first term.

Schools have already been operating under those earlier regulations. Monday’s final rule places the policy that the department has been enforcing into the published federal regulations.

The department said the remaining lawsuits involving the Biden administration rules were dismissed in August. Those dismissals cleared the way for the agency to formally remove the regulations from the federal rulebook.

Education Secretary Linda McMahon said the rule brings the published regulations into alignment with the court rulings and the enforcement policy used since Trump returned to office. She also presented the action as a return to the language adopted during Trump’s first administration.

McMahon said, “Today’s rulemaking clears the Biden Administration’s illegal rewrite of Title IX from the Code of Federal Regulations and restores the commonsense language promulgated in the first Trump Administration, which we have been enforcing since the first days of the Administration.”

She continued, “Thanks to today’s action, the published Title IX regulations faithfully reflects court orders and Congressional intent—reducing confusion for parents, students, and educational institutions.”

McMahon concluded, “We will continue to relentlessly champion equal opportunity for all Americans and hold accountable any school or college that violates the rights, privacy, or athletic opportunities of our women and girls.”

WATCH:

The final rule therefore makes the written regulations match the policy schools were already instructed to follow after the federal court rejected the Biden administration framework. It also removes provisions concerning gender identity and sexual orientation from the department’s Title IX policy.

The department’s action follows a 2025 executive order from Trump. That order directed federal agencies to recognize only male and female as sexes.

Trump’s executive order also instructed agencies to apply that definition while enforcing laws against sex discrimination. The Education Department’s final rule applies that approach to its Title IX regulations.

With the change taking effect Tuesday, the Education Department has completed the formal regulatory step that followed the January 2025 court ruling and the August dismissal of the remaining lawsuits. The 2020 rules now return to the published federal regulations.
