Dr. Kevin O’Connor, former President Joe Biden’s longtime personal physician, invoked the Fifth Amendment during a closed-door deposition with the House Oversight Committee on Wednesday, refusing to answer questions about Biden’s health and alleged efforts to conceal medical issues while he was in office.

House Oversight Committee Chairman James Comer (R-Ky.) confirmed that Dr. O’Connor, who served as the 46th president’s personal doctor, declined to answer any questions regarding Biden’s cognitive abilities or treatment for serious conditions, including advanced-stage prostate cancer.

The only question he answered, according to an Oversight spokesperson, was a confirmation of his name.
“Dr. O’Connor pleaded the Fifth Amendment,” Comer told reporters following the deposition.

“This is unprecedented, and I think that this adds more fuel to the fire that there was a cover-up.”
Comer said that Dr. O’Connor was asked two direct questions during the session:
- “Were you ever told to lie about the president’s health?”
- “Did you ever believe President Biden was unfit to execute his duties?”
In both cases, O’Connor declined to respond, citing his constitutional right against self-incrimination.

According to the Oversight Committee, doctor-patient privilege would not have prohibited O’Connor from answering questions related to what he personally observed or was told to say publicly.
Comer added in a written statement that the refusal to answer such questions suggested the existence of a coordinated effort to hide Biden’s declining mental fitness.
“It’s clear there was a conspiracy to cover up President Biden’s mental and physical decline,” Comer stated.
“Congress must assess legislative solutions to prevent such a cover-up from happening again. We will continue to interview more Biden White House aides to get the answers Americans deserve.”

Rep. Jasmine Crockett (D-Texas), who attended the deposition, defended Dr. O’Connor’s decision to remain silent.
“As someone who has served as a criminal defense attorney, I think that he did what any good lawyer would advise him to do,” she said.
Crockett also argued that answering questions could have put O’Connor’s medical license at risk.
Crockett went on to defend Biden’s capacity during his presidency.
“He completely understood what was going on,” she said.
“He may get fumbled up by words, but that’s not anything new and it’s not anything that came with age. There is nothing about Joe Biden and his stutter or him being older that caused any issues as it relates to potentially harming the American people.”
“The reality is that the country wasn’t off the rails when Joe Biden was sitting in the White House,” Crockett added, despite polling data that showed 83% of Americans believed the country was heading in the wrong direction during his term.
Biden exited office with the lowest recorded approval rating of any U.S. president.
The deposition is part of a broader investigation launched by the House Oversight Committee into potential misuse of executive authority and alleged concealment of the president’s health status.
Comer has also raised questions about the use of the presidential autopen to sign executive orders and pardons, a matter under scrutiny by the committee.
The panel’s investigation has been bolstered by claims from the May 20 release of Original Sin, a book by Jake Tapper and Alex Thompson, which alleges that a small group of Biden advisers functioned as a "Politburo" to manage the administration.
One of those advisers, Annie Tomasini, is scheduled to be interviewed by the committee on July 18.

- Steve Ricchetti, former counselor to the president, on July 30

- Anita Dunn, former senior adviser for communications, on August 7
An interview with Anthony Bernal, top aide to former First Lady Jill Biden, is scheduled for July 16. Bernal had previously declined to appear voluntarily.
The Trump White House confirmed it would not invoke executive privilege over O’Connor’s testimony or for that of other former Biden aides, including Neera Tanden and Bernal. Tanden testified for five hours without privilege protections, telling reporters there was “absolutely not” a cover-up of Biden’s health.
O’Connor’s legal counsel, David Schertler, also represented former NIAID Director Dr. Anthony Fauci during his testimony before the Oversight Select Subcommittee on the Coronavirus Pandemic.
In a separate but related case, a former public liaison at the National Institutes of Health invoked the Fifth Amendment last August instead of answering questions about efforts to obscure federal record requests tied to COVID-19’s origins.
The Oversight Committee’s inquiry into Biden-era decision-making and public transparency continues, with Comer vowing additional action as new evidence is gathered.
