WHAT YOU NEED TO KNOW
- Judge Matthew Sharbaugh approved the warrant to search Rep. Ilhan Omar’s Washington, DC area residence.
- Sharbaugh limited how Justice Department prosecutors could access Omar’s documents because of constitutional protections tied to her congressional role.
- Sharbaugh previously donated to Hillary Clinton and clerked twice for Obama appointee Judge Robert Wilkins.
- The search was connected to an ongoing criminal fraud investigation involving immigration paperwork completed by Omar’s late father.
Rep. Ilhan Omar, a Minnesota Democrat, has portrayed the federal search of her Washington, DC area home as political persecution driven by a vengeful President Trump. A new report about the judge who approved the warrant has now dealt that narrative a serious blow.
CNN reported Wednesday that Justice Department prosecutors had to secure approval from Judge Matthew Sharbaugh, a federal magistrate judge on the DC District Court. His involvement was not previously confirmed in public reporting about the search.
Before authorizing the warrant, Sharbaugh limited how the Justice Department could access Omar’s documents because she is a member of Congress. Multiple people familiar with the investigation told CNN that those restrictions concerned the constitutional protections afforded by her congressional role.
The judge who signed the warrant to raid Rep. Ilhan Omar's DC home is a Hillary Clinton donor who clerked for an Obama appointee. That fact alone demolishes the left's claim that this is some Trump-orchestrated political hit job.
Mike Davis argues the opposite is true: the evidence against Omar must be so overwhelming that even a judge with deep leftist ties couldn't refuse to sign off. The Fourth Amendment requires probable cause of at least one federal crime inside that home, and U.S. Magistrate Judge Matthew Sharbaugh — appointed by a bench dominated by Obama and Biden picks — found it was there. Omar's allies in Congress, including Reps. Alexandria Ocasio-Cortez, Jamie Raskin, and Rashida Tlaib, cried political revenge. But Davis says the simplest explanation is the most damning one for Democrats: a federal indictment may be coming before Christmas, and the evidence trail appears to reach well beyond Omar alone. The approval was not presented as an automatic rubber stamp. Prosecutors faced what CNN described as a prolonged back-and-forth with the federal magistrate judge before the search warrant was approved.

Sharbaugh’s identity had already been suspected by Mike Davis, the founder of the Article III Project and a former Senate Judiciary Committee counsel. Davis had publicly pointed to information posted on the DC U.S. District Court website.
According to Davis, the website showed that Sharbaugh served as the magistrate on criminal duty from October 3 through October 16, 2026. That period covered the raid, although Davis acknowledged there remained a small possibility that Sharbaugh might not have been available.
The confirmation drew additional attention because of Sharbaugh’s political and professional background. Davis noted in a Fox News opinion piece published Sunday that Sharbaugh had donated to Hillary Clinton during her unsuccessful 2016 presidential campaign against Trump.

Before becoming a judge, Sharbaugh also clerked twice for Judge Robert Wilkins. Wilkins was appointed by former President Barack Obama, and Sharbaugh worked for him on both the D.C. U.S. District Court and the D.C. U.S. Circuit.
The left calls the Ilhan Omar investigations a political hit job by President Trump.
But the judge who signed the search warrant? Judge Matthew Sharbaugh—a Democrat, Hillary Clinton donor, and former clerk for an Obama-appointed judge. And we’re supposed to believe he’s doing political favors for President Trump? — David J Harris Jr (@DavidJHarrisJr) October 15, 2026
Wilkins was one of three D.C. U.S. circuit judges confirmed near the end of 2013. That occurred under former Democratic Senate Majority Leader Harry Reid shortly before Republicans gained control of the U.S. Senate.
Sharbaugh has also issued a notable ruling against the Trump Administration. In August, he released a woman who had been accused of deliberately defacing the World War II Memorial and allowed her to leave custody on a personal recognizance bond.
Against that background, the notion that a compliant Trump ally casually approved a politically motivated raid becomes considerably harder to sell. The judge imposed limits on prosecutors before granting the warrant, specifically because Omar holds a seat in Congress.

Federal agents searched Omar’s residence early Monday morning as part of an ongoing criminal investigation involving her immigration paperwork. The documents at issue were filled out by her late father when Omar was a child.
The investigation concerns alleged criminal fraud connected to that paperwork. The search took place before dawn at Omar’s Washington, DC area residence.
Omar’s website states that she arrived in the United States in March 1995 at age 12. She came with her family as a Somali refugee after spending approximately four years in a refugee camp in Kenya.
According to the same account, Omar became a naturalized U.S. citizen in 2000 when she was 17 years old. Those details are part of the publicly stated timeline surrounding her arrival and citizenship.
Multiple federal agents wearing HSI jackets were seen outside the residence at approximately 6 a.m. Their presence marked the visible portion of a search that had already passed through judicial review and additional restrictions concerning Omar’s status in Congress.
Omar can continue insisting that Trump is targeting her for political reasons, but the newly disclosed warrant process complicates that accusation. A judge who donated to Clinton, clerked twice for an Obama appointee, and previously ruled against the Trump Administration still found sufficient grounds to approve the search, while limiting how investigators could examine congressional materials.
