  • Toney displayed agency records referencing hiring freezes in 2022 and 2025.

  • Kaul’s tenure has also faced criticism over crime lab delays and actions involving religious charities.

Over the weekend, Republican Eric Toney debated Wisconsin’s incumbent Attorney General, Democrat Josh Kaul. Toney centered his attack on years of hiring freezes at the Wisconsin Department of Justice and arrived with records to support his case, as reported by Townhall.

Earlier this year, Kaul decided against running for governor and instead sought another term as Attorney General. After Toney’s document-driven performance, that choice looked considerably less comfortable for the Democrat.

The Wisconsin DOJ has operated under hiring freezes for years. Kaul has blamed others for a lack of positions, but he has also chosen not to fill open jobs across the agency.

The state crime lab has struggled with turnaround times for testing during Kaul’s tenure. Those problems gave Toney a clear opening to challenge the incumbent’s management of the department.

During the debate, Kaul accused Toney of lying about the hiring freeze. Toney did not merely issue a denial or trade another accusation with the incumbent.

“We’re going to make sure there’s never a hiring freeze in place,” Toney said.

Toney then pointed directly to records from Kaul’s own agency. “And what we’ve seen, you know, these are emails from his own Department of Justice, if you’d like to look. 2022: hiring freeze.”

He continued laying out the timeline contained in the documents. “2025: hiring freeze. More of those emails where they’ve had hiring freezes in place.”

Toney also explained how the records were obtained. “These are emails his office provided to the state Senate that we got through a public records request.”

The Republican argued that Kaul was relying on a distinction tied to the current election year. “And so now what he’s doing is playing a sleight of hand, saying that well, now maybe they don’t have a hiring freeze during an election year.”

Toney then turned Kaul’s own previous campaign argument against him. “And what he said in 2018 was that it shouldn’t take an election year to get on top of the crime wave.”

The records displayed by Toney included notes from a September 18, 2025, meeting. Those notes said the “hiring freeze countdown” was “still underway.”

Another email dated October 12, 2022, referred to the “year-end hiring freeze.” Together, the records directly challenged Kaul’s accusation that Toney had lied about freezes within the agency.

The exchange was especially damaging because Toney used material Kaul’s office had supplied to the state Senate.

The records were obtained through a public records request rather than appearing as an unsupported debate stage claim.

The hiring dispute also brought renewed attention to the state crime lab. Testing turnaround time has remained a problem, while other issues have also persisted under Kaul’s watch.

Kaul’s record has drawn criticism beyond hiring and crime lab performance. He targeted Catholic Charities and other religious charitable groups in an effort to strip their tax exempt status related to unemployment.

The Supreme Court rejected that effort. Kaul has also blocked the Trump administration from obtaining voter rolls and SNAP enrollment information.

Kaul additionally sued the Trump administration in a dispute involving procedures on children. The criticism surrounding that lawsuit added another sharp point of contrast between the Democratic incumbent and his Republican challenger.

Through it all, Kaul sat and smirked as Toney displayed the records. The expression did little to answer emails referencing hiring freezes in both 2022 and 2025.

Toney’s debate strategy was simple and effective: make the accusation, show the documents, identify their source, and let Kaul’s own agency records speak. For an incumbent accusing his challenger of lying, that was a brutal stack of receipts to have dropped in public.
