The Justice Department is seeking a federal criminal indictment of former White House aide Cassidy Hutchinson for allegedly lying to Congress during her January 6 testimony, according to PunchBowl News. The reported move puts the former congressional star witness under mounting legal scrutiny.

Reports earlier this year said the Justice Department had launched an investigation into Hutchinson. The latest report says the Civil Rights Division presented evidence to a federal grand jury this week.

Hutchinson has not been subpoenaed to appear before the grand jury, according to the report. Assistant Attorney General for the Civil Rights Division Harmeet Dhillon is spearheading the investigation.

“DOJ is seeking a federal criminal indictment of former WH aide Cassidy Hutchinson on charges of lying to Congress in her Jan. 6 testimony,” PunchBowl News reported.

“DOJ’s Civil Rights Division brought evidence to a federal grand jury on Tuesday and is expected to present more evidence and additional witnesses later this month, per sources familiar with the plans. Hutchinson has not been subpoenaed to appear before the grand jury, per the sources,” the outlet reported.

Hutchinson testified in June 2022 that Trump entered “the beast” after delivering the speech. According to her testimony, Trump believed he would then be driven to the Capitol.

Hutchinson said she received information about what happened next from Tony Ornato, identified as the Assistant Director for the Secret Service. She testified that Trump became angry after learning he was instead being driven back to the West Wing.

According to Ornato’s alleged account as relayed by Hutchinson, Trump shouted, “I’m the f*cking president! Take me up to the Capitol now!”

Hutchinson further alleged that Trump reached toward the driver, grabbed the steering wheel, and tried to commandeer the presidential limousine. Her account quickly became one of the most dramatic claims produced by the congressional proceedings.

She then claimed Secret Service Agent Bobby Engel grabbed Trump’s arm and removed his hand from the steering wheel. Hutchinson presented that account as information passed to her rather than an event she personally witnessed.

A House oversight subcommittee headed by Rep. Barry Loudermilk of Georgia later examined testimony connected to Trump’s January 6, 2021, speech at the Ellipse. The subcommittee reviewed unreleased testimony from four White House employees who were present for the speech.

According to the subcommittee, that testimony “directly contradicted claims made by Cassidy Hutchinson.” The finding placed Hutchinson’s highly publicized account squarely back under scrutiny.

Later reports also found that Liz Cheney coached Hutchinson before her testimony.

The Justice Department has now taken evidence before a federal grand jury and reportedly expects to offer additional evidence and witnesses later this month. Hutchinson, however, had not been subpoenaed at the time of the PunchBowl News report.
