Missouri Attorney General Andrew Bailey is calling on the U.S. Department of Justice to investigate whether aides to former President Joe Biden concealed his cognitive decline to push through a far-left agenda before he left office.

Bailey’s demand raises serious concerns over the legitimacy of Biden-era policies, many of which have been rolled back since President Donald Trump returned to the White House in January.
In a public letter addressed to DOJ Inspector General Michael E. Horowitz, Bailey argued that many of Biden’s executive actions should be considered invalid due to the president’s mental incapacity.

He pointed to Biden’s decision to withdraw from his reelection campaign under pressure from fellow Democrats as further evidence of his declining cognitive abilities.
“By now, Biden’s mental decline is famous. Under the 25th Amendment, his inability to make decisions should have meant a succession of power,” Bailey wrote.
“Instead, it appears staffers and officers in the Biden administration may have exploited Biden’s incapacity so they could issue orders without an accountable President of sound mind approving them.”
Bailey went on to suggest that this could explain the aggressive leftward shift of Biden’s policies.
“That would explain why the Biden administration’s orders were aggressively much farther to the left than any previous President. If in fact Biden’s staffers were exploiting his mental decline, those orders are null and void.”

During Biden’s presidency, Republican lawmakers and conservative commentators repeatedly questioned his fitness for office, urging his cabinet to invoke the 25th Amendment.
However, no public evidence suggested that Biden’s inner circle seriously considered removing him.
Instead, his aides limited his public appearances, kept press interactions brief, and ensured his remarks stuck to scripted teleprompter messages.
Bailey’s letter also raises concerns about financial decisions made under Biden’s administration.
He referenced a recent report from the U.S. Department of Government Efficiency, which uncovered a $2 billion grant issued by Biden’s Environmental Protection Agency to an organization founded by Stacey Abrams.
The grant, Bailey suggested, could be an example of unelected progressive bureaucrats using Biden’s incapacity to advance their own agenda.
Bailey cited a recent interview with House Speaker Mike Johnson (R-LA) as further evidence that Biden may not have been fully aware of the policies issued under his administration.
Johnson recalled an interaction with Biden regarding an executive order restricting liquefied natural gas (LNG) exports, a move that significantly impacted Louisiana’s economy.
“I didn’t do that,” Biden allegedly told Johnson when confronted about the order, according to the New York Post.
“Sir, you paused it, I know. I have the export terminals in my state. I talked to those people in my state, I’ve talked to those people this morning, this is doing massive damage to our economy, national security,” Johnson responded.

Bailey referenced this exchange as a “profound reason to suspect that Biden’s staff and political allies exploited his mental decline to issue purported presidential orders without his knowing approval.”
In his final hours in office, Biden issued a flurry of executive orders and pardons, including one for his son, Hunter Biden, who had been facing federal tax evasion charges.

Additionally, most federal death row inmates had their sentences commuted to life in prison, another move Bailey claims could have been orchestrated by Biden’s aides.
“Who has been running the country for the last few years?” Bailey asked in his letter.
“I fear that Mr. Biden, while he held the office of President, did so in name only and was a mere puppet for far-left, unelected staffers. The people deserve to know the truth.”
Bailey’s call for a DOJ investigation adds to the growing Republican push to examine the extent of Biden’s cognitive decline and its impact on federal policymaking.
It remains to be seen whether the DOJ will act on Bailey’s request.
