CNN has been calling the death of a Border Patrol agent in Texas over the weekend a “mystery” and dismissing assertions that the agent was beaten with rocks, pushing viewers toward reports that he may have fallen. But a spokesman for the union that represents Border Patrol agents says CNN has the story wrong.

Chris Cabrera, the spokesman for the National Border Patrol Council (NBPC), told Laura Ingraham on Fox News’ “The Ingraham Angle” on Tuesday that CNN’s story doesn’t make sense if one looks at the area in southwest Texas where the agents were found.

“The area around it, it’s a culvert, not a ravine,” said Cabrera. “It’s about 9 feet off the ground.”

The ground, he said, is sandy dirt.

“If somebody fell there, is it possible that they could have died from that? It’s possible, but it’s highly unlikely,” he said.

“These agents know that culvert’s there. It’s right off I-10,” he said.

Cabrera also questioned why, if it were an accident, there’s a $20,000 reward being offered.

“If it’s an accident, who would possibly collect that reward?” he asked.

He referred to the sheriff who was quoted in the CNN story as saying the agents must have fallen.

“I hate to be rude, but he doesn’t really know what he’s talking about,” he said.

Both agents were found near the culvert with similar injuries. Rogelio Martinez, 36, succumbed to those injuries, dying in a hospital on Sunday morning. The cause of death was determined to be blunt force trauma to the head. He and the other agent, whose name has not yet been released, both had numerous broken bones, according to reports. Neither man was shot.

“Clearly, if this had been an attack by some type of cartel-affiliated group of individuals — illegal immigrants or not — that would of course bolster the president’s arguments that we need real border security,” Ingraham said. “We need to empower the border patrol, we need more of them, and we need a wall.”

“These individuals that were hiding, they were able to attack these agents, and they were able to take these agents out.”

“But if it’s an accident,” she said, “well, they either just drove off into that culvert, which doesn’t seem really tall to me, sandy, they fell off, and just hit their head and died, then it doesn’t really add to the argument of the wall, does it?”

Brandon Judd, the president of the NBPC and also a guest on the show, said that Martinez had radioed in that he was following footprints right before what he presumed was the assault.

He said it’s like when kids play hide-and-seek: The person who is hiding sees the person who is coming before they are seen, especially as Martinez was carrying a flashlight.

“These individuals that were hiding, they were able to attack these agents, and they were able to take these agents out,” he said. The surviving agent remained in critical condition on Tuesday.

During the segment, Ingraham showed a photograph of the culvert where the sheriff surmised that the agents may have fallen. It shows a two-lane road with a small piece of bridge held up by supports with a culvert underneath, presumably for water drainage. It appears from the photograph that the only kind of fatal head injury that could be caused by a fall would have to involve a head-first fall, or a dive, off the edge of the road.

Texas Gov. Gregg Abbott tweeted on Monday that he was offering a $20,000 award to anyone who could help solve the case.

President Donald Trump also tweeted about the Border Patrol agents, and it was this tweet that seemed to set off CNN.

“Border Patrol Officer killed at Southern Border, another badly hurt,” Trump wrote. “We will seek out and bring to justice those responsible. We will, and must, build the Wall!”
