Special Counsel John Durham is reportedly going to call former FBI attorney James Baker to testify in the case against former Hillary Clinton campaign lawyer Michael Sussmann, who is facing criminal charges for allegedly lying to Baker back in 2016.

During a status hearing held on October 26th, federal prosecutors on Durham’s team indicated their plans to call former FBI general counsel Baker to testify in the case against Sussmann – the very man that prosecutors claim Sussmann lied to during a September 2016 meeting that resulted in the charge he’s facing.
The indictment against Sussmann alleges that he told Baker during the September 2016 meeting that he wasn’t working “for any client” while sharing data and evidence that purported then-candidate Trump had a secret communications channel with him Alfa-Bank – a financial institution with ties to the Kremlin.
However, prosecutors say that the lie conveyed was that Sussmann did have a client – as he was a lawyer reportedly working for the Clinton campaign at the time.
Due to the hundreds of pages of confidential information involved in the case, U.S. District Judge Christopher Cooper urged both the prosecution and Sussmann’s defense to continue moving ahead in their discovery process, which could potentially take several months based upon documents associated with the case.
During the hearing, federal prosecutors said that they had handed over 6,000 documents to Sussmann’s lawyers, totaling up to roughly 80,000 pages thus far.
Judge Cooper acknowledged that the discovery process would be burdensome but advised both the defense and the prosecution to craft a target date for a trial to begin either in late 2021 or early 2022. Reportedly both the prosecution and defense agreed that they’d aim for a trial to start in spring of next year.
The next status hearing is slated for December 2nd.

As we previously reported, AG Merrick Garland confirmed that Special Counsel Durham’s investigation will continue unimpeded, with AG Garland saying his work is “continuing” and that he’s been approved for funding and is “still in action.”
