The disgraced British socialite Ghislaine Maxwell got some bad news from a federal judge this week when her bid to drop the sex trafficking charges against her in the wake of Bill Cosby’s overturned conviction was rejected.

Daily Mail reported that Maxwell’s lawyers had tried to claim that she had a non-prosecution agreement (NPA) just like Cosby did that Jeffrey Epstein signed with federal prosecutors in Florida in 2007. However, U.S. District Judge Alison Nathan wasn’t having any of it, and she said that the argument isn’t “persuasive.” She also said that Epstein’s NPA has no bearing on Maxwell’s case because she didn’t sign any agreement herself.

This comes two months after the Pennsylvania Supreme Court found a decades-old NPA with a different prosecutor that should have shielded him from charges. Cosby then walked out of prison after serving three years of a three-to-10-year sentence in June.

“The (Cosby) case focused on whether prosecutors were required to honor a promise that the court found to be clear in the absence of a formal plea agreement,” Judge Nathan wrote in her decision. “Even if this court agreed with the analysis in Cosby, that opinion sheds no light on the proper interpretation of the NPA in this case.”

“After considering the arguments in Maxwell’s renewed motion and letter of supplemental authority, the Court’s view remains unchanged from its April 16, 2021 Opinion & Order,” she added. “Under Second Circuit precedent, the NPA does not bind the US Attorney for the Southern District of New York. It thus does not bar the charges in the superseding indictment.”

This means that Maxwell will continue to stay in her Brooklyn jail awaiting trial. She has pleaded not guilty to an eight-count indictment accusing her of providing underage rape victims to the late billionaire pedophile Jeffrey Epstein, who killed himself in 2019 in a prison located across the river from Maxwell’s jail. Maxwell is facing up to 80 years in prison if she’s found guilty.

Maxwell’s lawyers have been trying for months to get the indictment thrown out, or to at least secure bail for the socialite, but all of these attempts have been unsuccessful.
