Before you accuse Alan Dershowitz of being in league with the deep state, Beelzebub, and the Greater Beijing Chamber of Commerce, try to remember he was on the team, chosen by Trump, to defend the president during the Senate impeachment trial earlier this year. So we’re not talking about some wild-eyed DJS sufferer here.

His analysis, combined with the presidential go ahead to GSA for a transition to the Biden administration, does not make for a great day for Trump bitter enders.

Also, conservative icon Rush Limbaugh on Monday tearing apart overreaching legal claims of the Sidney Powell variety gives a legitimate conservative imprimatur to Dershowitz and his conclusions.

FNC: “Harvard Law Professor Emeritus Alan Dershowitz said Sunday that while President Trump has a number of legal theories he can pursue in his efforts to swing the 2020 election result in his favor, it does not appear likely that these efforts will be successful. Dershowitz, who was on Trump’s legal team during his impeachment, told Fox News’ ‘Sunday Morning Futures’ that there are several avenues that Trump could take, but that even those options currently appear limited in their ability to secure an election victory.”

He mentioned that the Pennsylvania legal avenues have merit, but they may not offer the kind of remedy needed to overturn even a flawed and illegitimate election result. This is because a successful fight in Pennsylvania does not restore enough numbers to the Trump tally to give the state to the president. And then there is the timing.

“Once the electors are certified, and once they cast their vote I can’t see any legal route to undoing that, even if they were to find fraud later on,” Dershowitz said. “There’s certainly nothing in the Constitution about that.” The Electoral College meets on December 14th, about three weeks away. Will the Supreme Court get the cases and review them in time to affect the outcome? Would they be willing to overturn a presidential election certified by the Electoral College? Very very doubtful.

But, according to Dershowitz, the one legal dog that currently won’t hunt because of lack of evidence is the Dominion case being pushed by egomaniacal show pony Sidney Powell.

Says Dershowitz, “The allegation that does cover enough numbers is the one that the Dominion computer systems were compromised to the degree that hundreds of thousands of ballots were affected. There are enough votes to make a difference but I haven’t seen the evidence to support that,” he said. “So in one case they don’t have the numbers, in the other case they don’t seem yet to have the evidence, maybe they do, I haven’t seen it. But the legal theory is there to support them if they have the numbers and they have the evidence.” There’s the rub. And it’s the same question we on the Right posed to the Left during the Russian hoax, impeachment, and on charges of presidential racism: Where’s the proof, where’s the evidence? The question is legitimate, no matter what the issue.
