Harvard Law School Professor Emeritus Alan Dershowitz (pictured above) rebuked Democrats Monday for pushing the “absolutely foolish, inconsistent and hypocritical” idea of impeaching Supreme Court Justice Brett Kavanaugh if they retake the House following the November midterm elections.

“That would be absolutely foolish, inconsistent and hypocritical. Those who believe that [former President] Bill Clinton should never have been impeached for allegedly lying about his sex life are now going to lead the campaign to impeach Kavanaugh for allegedly lying about his sexual and drinking activities back when he was a 17-year-old?” Dershowitz said during an interview on Fox News’ “America’s Newsroom.”

“It’s hypocrisy run rampant,” Dershowitz continued. “I think that the Democrats are shooting themselves in the foot. We ought to be moving forward.”

The Senate confirmed Kavanaugh Saturday following a grueling process that turned brutal during its last three weeks after Christine Blasey Ford accused Kavanaugh publicly on September 16 of sexually assaulting her 36 years ago during a high school gathering in Maryland.

Two other women, Deborah Ramirez and Julie Swetnick, also came forward with accusations of sexual assault. Kavanaugh strenuously and passionately denied the allegations, and none of the witnesses the women said would verify their claims did so.

Kavanaugh was confirmed 50-48 Saturday and sworn in later that day.

But Democrats — many of whom tried mightily to tank Kavanaugh’s nomination well before the sexual assault allegations became public — are now talking about whether they can or should impeach Kavanaugh.

House Minority Leader Nancy Pelosi (D-Calif.) filed a Freedom of Information Act (FOIA) request Sunday seeking all documents related to the FBI’s investigation into the allegations against Kavanaugh. Some Democrats also claim Kavanaugh could be impeached if he misled the Senate about his high school and college drinking habits.

But Dershowitz wrote an op-ed for Fox News published Sunday called, “Kavanaugh and impeachment – Democrats, don’t try to conduct a revenge inquisition.”

“Because I am a liberal Democrat, I want to see the House flipped to my party as an important check and balance between the executive and legislative branches,” Dershowitz wrote. “But what I don’t want to see is a Democratic House abuse its authority by conducting vengeful impeachment proceedings against Kavanaugh.”

Dershowitz doubled-down on his warning to his party during his “America’s Newsroom” interview.

“The irony is that the very same people — the very same people who justly complained about the use of perjury against Bill Clinton — are now demanding the use of perjury against Kavanaugh,” Dershowitz said. “Do they have no shame? Do they have no memory? Do they have no concern about being called hypocrites?”

“Is it really the case that, if the shoe was on the other foot, the principle goes out the window? Shame on Democrats who would apply the same principles that they opposed when Bill Clinton was impeached to impeach a sitting justice of the Supreme Court,” Dershowitz added. “Shame on them.”

Former independent counsel Kenneth Starr’s investigation led to Clinton’s impeachment in 1998 by the Republican-led House of Representatives for perjury and obstruction of justice charges. The Senate, also Republican-led, declined to convict Clinton.

“I think the leadership of the Democratic Party has to take control over their rogue members and has to be able to tell individuals like [Rep.] Maxine Waters [D-Calif.] who says she wants to impeach virtually everybody for everything, including [Vice President] Mike Pence, that that’s not what the Democratic Party is all about,” Dershowitz insisted.

“The Democratic Party has to become more mainstream, has to look to the future,” Dershowitz lamented. “This has become a total mess, and we have to begin to move forward and not take revenge for past losses.”
