There is uncertainty and confusion, it seems, for Joy Behar of “The View” when it comes to the president’s authority to nominate Supreme Court justices.

On Tuesday, Behar bemoaned President Donald Trump’s ability to nominate a justice to the high court — he chose Brett Kavanaugh on Monday night — to replace the retiring Justice Anthony Kennedy.

“How dare he be allowed to do this when he is under investigation!” Behar said.

Apparently, she did not grasp the irrelevance of her statement — or that special counsel Robert Mueller himself said President Trump was not officially the target of the controversial investigation into Russian collusion charges during the 2016 election.

The segment began when co-host Whoopi Goldberg teed up the discussion of Kavanaugh’s nomination to the high court. Former lawyer and co-host Sunny Hostin gave a measured response and said she believed Kavanaugh to be a “moderate conservative.”

Conservative co-host Meghan McCain tried to reassure everyone on the panel that the nominee could have been “worse.”

The segment then spiraled out of control as Joy Behar went into hysterics over the notion that President Trump would be “allowed” to pick a Supreme Court Justice.

It is too rich. It’s also predictable, considering Behar’s history of ridiculous air-headed comments.
